About The Lawsuit
From May 14. 2024 to present, we believe that the Chelsea Meadows Condominium Association authorized by Board members Marianella Yepez, Barbara Maimoni, Jennie Guidinio, Ihab Fadley and Zoraida Rosado illegally recorded audio sounds and private conversations of residents and visitors outside in the common areas of the development without prior knowledge or consent of the residents and visitors. Several non-board members were given unrestricted access to all the audio recordings.
Through a network of 14 cameras and microphones placed throughout the development. video and audio was recorded, transmited and stored during this time period.
Well over 100,000 hours of illegally recorded audio may have been obtained by the 14 cameras over the last 19 months. Audio of residents, visitors and their children were recorded without their prior consent.
When Marianella Yepez and other Board members were informed by several owners in 2024 that it was illegal to record audio without consent, they told the owners that the camera microphones had been disabled.
This was clearly false since we have obtained numerous camera recordings that were made in 2025 that have audio. A 1-minute clip recorded on February 10, 2025 by the camera in the courtyard by the pool is posted on the right. The people in the clip were unaware they were being recorded, but have consented to have this clip posted to make other residents aware that the Association is recording audio without consent.
Florida Statute 934.03 prohibits recording of audio without the prior consent of all parties involved. Florida Statute 934.10 provides for specific civil remedies for illegal audio recording without consent of $100 per day or $1000, whichever is higher. Under Florida Statute 934.03, any person who records or authorizes the recording of illegal audio is also guilty of a 3rd degree felony. We plan to file a class action lawsuit against Chelsea Meadows Condominium Association and the above Board members for civil damages as provide for in the Statutes. Once all the evidence of these audio recordings have been obtained through discovery with the court, local law enforcement will be contacted for possible criminal prosecution. If you, a family member or a visitor had what you believed were private conversations in the common areas, you may be eligible for a share of any settlement obtained. To share in any settlement, you will need to register as a potential class member.
